「協働」という概念は「まちづくり」から始まったのではないか？と先の投稿「契約法の再構築」で述べました。内田先生も「共同」ではなく「協働」だと説かれておられます。
恐縮ですが、私の「契約とは？」の定義を今一度ご確認ください。
【定義】
自己（以降「内部」と言換える場合があります。）と自己以外（以降「外部」と言い換える場合があります。）が「目的」実現のために、交わす「取り決め」、および「目的」実現のための「活動」。
人の活動は、自己以外の人との「関係性をどうするか」その「活動」です。（当サイトは「自己との約束」も含めて「契約」と考えています。つまり、実現できていない自己（「未実現の自己」）は未だ「外部」環境であり、「自己実現の活動」（＝「外部」環境の「内部」環境化への活動」）も「契約」と考えます。としていますが、ここでは、ひとまずこの「自己との約束」は置いて考えます。）
そうしますと、人の活動は、自己以外の人との「関係性をどうするか」の「契約活動」そのものであることが解ります。そして先の「契約法の再構築」内の引用文にありますように「協働の関係としての契約」が、「普遍的な光の中に再登場したのであります。ユニドロワ契約原則にも規定されています。現代の契約法は、協働を支えるものでなければならないとされます。
こう考えると、「協働」は「まちづくり」に限らず、全ての人の活動に共通（必須）な「行動原理」であることが解ります。（あるいは「まちづくり」が全てを包含しているともいえます。）
したがいまして、全て（人と人との関係づくり全て）が「契約活動」であり、「契約に至るプロセス」であり、「契約」とはプロセス活動ということになります。
